Since 2018, 25 utilities across 19 states have crafted new tariffs for data centers. Their biggest win? Nailing ratepayer protection. The tariffs come with an average demand ratchet of 79%, a new Latitude Intelligence report finds. Clearly, they’ve got much more bite than the White House’s toothless ratepayer protection pledge. But these tariffs don’t cover most of the country—including Texas and California, where hyperscaler activity keeps heating up.
