West Virginia PSC Issues Final Commission Order Involving Appalachian Power

CHARLESTON, West Virginia, Oct. 7 -- The Public Service Commission of West Virginia issued the following final commission order (Case No. 20-0551-E-P):

APPALACHIAN POWER COMPANY Petition for certification of revenue deficiency associated with the 20% Rate Discount Program.

FINAL COMMISSION ORDER

On July 24, 2020, Appalachian Power Company filed P.S.C. W.Va. Form No. 214.6, pursuant to Article 2A of Chapter 24 of the W. Va. Code and G. 0. No. 214.6 of the Public Service Commission of West Virginia. Appalachian Power Company's filing indicated that it had experienced a revenue deficiency of $2,737,778.25 for the December 2019 through April 2020 billing months.

All of the operating divisions of the Commission have had an opportunity to review the filing, and by Initial Joint Staff Memorandum filed August 31, 2020 and Final Joint Staff Memorandum filed October 5, 2020, the Legal Division of the Commission submitted the Staff recommendation in this proceeding. Staff recommended that $2,737,778.25 be certified as the revenue deficiency for Appalachian Power Company associated with the 2019-2020 20% rate discount program. It is unnecessary to adjust or net the requested revenue deficiency for tax effect caused by the conversion of revenue dollars to tax exempt credits because Business & Occupation taxes are calculated on the basis of kilowatt hours instead of gross revenue.

FINDING OF FACT

Appalachian Power Company experienced a revenue deficiency of $2,737,778.25 as a result of the implementation of the 20% rate discount program for the December 2019 through April 2020 billing months. Final Joint Staff Memorandum filed October 5, 2020.

CONCLUSION OF LAW

A revenue deficiency of $2,737,778.25 should be certified for Appalachian Power Company as the revenue deficiency experienced by it as a result of its participation in the 20% rate discount program for the December 2019 through April 2020 billing months, pursuant to the requirement of General Order No. 214.6 and Article 2A of Chapter 24 of the W. Va. Code.

ORDER

IT IS, THEREFORE, ORDERED that $2,737,778.25 is hereby certified as the revenue deficiency for Appalachian Power Company as a result of the implementation of the 20% rate discount program for the December 2019 through April 2020 billing months, pursuant to Article 2A of Chapter 24 of the W. Va. Code and General Order No. 214.6.

IT IS FURTHER ORDERED that this proceeding is removed from the Commission's docket of open cases.

IT IS FURTHER ORDERED that the Executive Secretary of the Commission serve a copy of this order by electronic service on all parties of record who have filed an e-service agreement, and by United States First Class Mail on all parties of record who have not filed an e-service agreement, and on Commission Staff by hand delivery.
