Colombia and regulation of electric vehicles

The Ministry of Mines and Energy in Colombia published a draft resolution which seeks to establish the minimum conditions and standards for the implementation of charging infrastructure for electric vehicles in Colombia.
Some of the points that the regulation on electric vehicles in Colombia will have are the following:
First, the provision of electric charging service may be exercised by any person, whether natural or legal. This means that it is not a domestic public service and therefore, it will not be required to be a Public Service Company to enter the Colombian electric vehicle charging market.
Second, the price for the electric vehicle charging service in public charging stations will be free. That is, it will not be regulated. Such price may be expressed in kilowatt-hours or by sessions, depending on its variation and intensity.
Thirdly, the Energy and Gas Regulation Commission may analyze the hourly rate signals, the response to the demand that may arise and thus establish mechanisms for the transaction and management of the energy destined to supply said market. In addition, it may establish special conditions for the differentiated measurement of electric energy consumption for electric vehicle charging, the procedures for connection of stations and other rules it considers applicable to residential and non-residential users of the public electric energy service.
Fourth, the general rule is that charging stations or points are for public use. However, it is proposed that they be for private use. In any case, whether for public or private stations, they must comply with all the requirements of the Technical Regulations on Electrical Installations, also known as RETIE, and the international standards set forth in IEC 62196 concerning connectors and charging methods for electric vehicles.
Fifth, the providers of the charging service must provide all the information attributable to the appropriate methodology for charging the vehicles, its precautions, cost, charging time and instructions or means of payment for the service provided.
Sixth, the stations will have three types of charge levels for electric vehicles, the first is the slow charge type which its nominal power is less than 3.7 kilowatts, the second is called semi-fast charge type where its power is greater than 3.7 kilowatts and no more than 22 kilowatts, and the third level is classified as fast charge where its nominal power is greater than 22 kilowatts.
Seventh, the energy distribution companies will verify compliance with the minimum standard of the connector, prior to the approval of the application for a connection point made by the natural or legal person wishing to provide charging services to electric vehicles.
In Colombia, the legal framework for electric vehicles is gradually being developed, and this has been in place since Law 1964 of 2019, known as the "Electric Vehicle Law¨.
