The pursuit of C-SCRM solutions for Small and Medium Businesses (SMB) to preserve these legal protections against punitive damages has been submitted to CISA ICT_SCRM as a topic for consideration to help SMB's protect themselves from supply chain risks and punitive damages in the event of a data breach:

"The CISA ICT SCRM Task Force, Small and Medium Business (SMB) Work Group understands the difficult challenges SMB’s face with regard to the implementation of best cyber practices, i.e. C-SCRM best practices, to prevent from becoming a victim of cyber-crime. These new State laws, and the recent letter to private industry from Anne Neuberger, presents an opportunity for the SMB working group to provide practical guidance on real solutions that can help an SMB protect themselves from software supply chain risks that can lead to the exposure of sensitive and/or restricted data and enable them to produce proper evidence data required to preserve legal protections against the payment of punitive damages, in the event that a data breach were to occur.   "
